Hey guys

I have just been given a fine from a cop for "operating a noisy vehicle". He told me my exhaust was too loud and I told him it was factory. I am taking this to court as I know my vr4 is standard and is definitely not noisy! I have a 1996 galant vr4 and was wondering if you guys could PLEASE tell me what the standard exhaust TIP on these are???

Did he use a db meter to determine this?? If not and if it was not recorded there is no proof!!! However if its like australia over there, when a police officer says something in court it is more valued opinion than that of a regular citizen.

Nope i told him to decible test it and he said na its my opinion and i think its noisy...****n bullshit!!! vr4s arnt even noisy! its just the v6 that makes it purr. When my galant and his Commodre were idling next to each other when he pulled me over his car was louder lmao watta JOKE!!!

Over here in Victoria, a cop cannot issue such a fine. They can report the vehicle to the EPA for a test or issue a Defect Notice if the car is missing a muffler or something.

Sounds strange to me but i know cops will do that if you are being a hoon and they can't prove it. They will pick something on the car to give you a ticket for.

Yeah cos in Christchurch boy racing is a big problem at the moment and they just try and do young drivers for anything.

Anyways, how do I prove that my exhaust is completely factory standard???

I don't think factory standard will be an issue. Just take it to some Government place and get is Sound Pressure tested, then just take the certificate to the cops/court (so long as it is under of course).

As Chris said BUT make sure that you get a current valid calibration certificate on the device that was used to do the testing. Once you have that they can't claim that the testing device was incorrect.

I had a mate that drove his brand new VE SS commodore out of the showroom, and on the way home got a yellow sticker from the cops for it being too loud. He obviously tried to explain the situation, showed him the receipt etc, but the cop wouldn't have a word, and on the yellow went. He took it to the pits and the guys there didn't even look at it, and let it pass instantly.

I reckon behavior like that should go to the media, it is unnecessary.

Anyway, like someone mentioned. Get a dB test done and get it certified or something tangible that can be produced in court. Maybe a WOF testing station could help you out?

If the copper didn't have any measuring device on him at the time and simply used dead reckoning, then that should not legally hold up to a certificate. That is, of course, ASSUMING that the certified volume is less that whatever the legal limit is now. They really shouldn't be able to claim that you've quietened it down since the intercept, but again they have no scientific or measurement backing to support that allegation.

What type of places do decible testing?
He just said he could hear me going past him so therefor its a noisy vehicle. Im going to try my hardest to beat this stupid fine.
He looked at the size of the exhaust and thought it was too loud, after he gave me the ticket he outlined the size of the exhaust so he thinks it is quite big, which it is quite big but is definitely not noisy. VR4 engines are alot noisier then the exhausts. But yeah he has no proof that it is noisy, just his ears nothing else!!! BS

I'd look at taking the fine if it's small, just swallow your pride and pay. The cop was probably having a bad day and felt like being a bit of a fool...they'll do that. It'll probably cost you more to take it to court, and judges will believe the cop over you, guaranteed. I think just pay the fine, get the car Db tested and get a certificate stating it is under the Db limit so you can never get fined again. It's up to you but I believe taking it to court will just end up being a frustrating and expensive experience. So how much was this fine anyways?

It was 50 dollars but 25 demerit points, a few more demerit points and i lose my license, thats why its a big hastle. Loss of license = loss of job = loss of life =S

That is so f**kin stupid! It's not like you were hooning or breaking road rules, it's a damn exhaust!! I guess that changes things though, money can be earned again, but points are hard as hell to get back. Maybe it IS worth taking them to court...
