Its a different gearbox to my first one Christian I bout this one from Trent in Perth and they rebuilt that one as the soft parts were warnwarn.

I have already called small claims and basicly I have to go to the trans mob and ask them if they will honour their warranty or I will take them to small claims and if they refuse they will loose.

I got my boss to have a look and see if it was from his old shop would he honour the warranty or not and he said they would honour it. He used to own Rocky Automatics so he knows a thing or 2. He is also gonna contact an old workmate from there about it and see wat they say about it.

Now to call them tomorrow and ask about it... Or should I sneak in there with my boss and ask them in person hmmm thats probly a better idea

try not to do anything sneaky as it might turn around and make it more harder..

usually if you're gonna take things legally.. like where this is going.. keep in mind that evidence is your friend..

Thats y im thinking for going there with my boss. He knows alot more bout this kind of thing plus he would be an excellent witness to have if it goes to legal side of it. I wouldnt call it sneaky more playing it safe aswell as talking to them in person is alot better then over the phonephone and bringing an expert in could scare them into folding alot easier but I guess could go the other way too. I just need this sorted asap so I can get my car back

Also I have 3 pages typed up of what has happened, when ive contacted them on issues aswell as wat they have said to me and the bottom of it all I have wat Steve said about my car and another mechanic who altho never came in the car gave me good insight on wat he belives is the issue before it malfunctioned plus he has heard me taking off normally and could easily hear it slipping.
Im trying to get as much together as I can before I hit them with it just to be safe, including asking another trans specialist to look at the invoice and me describing the events and find out wat their professional opinion is

Haha thanks mate

I called a auto trans specialist and described everything and he said if they dont cover the warranty repairs take them to small claims and they will loose which is exactly wat I wanted to hear.

Im even looking at prices for all parts inside the gearbox to give to them to get the parts from and make sure they use genuine parts only ill get them to provide invoices to prove it... Just waiting for some more prices before I go in with everything including a 3 page report on all that has happened since the rebuild with phone records to prove it and see their faces after that

Your going the right way about this, If you are going to a small claims court cant you ask for a refund instead of the rebuild?

It just does not make sense. PLEASE HELP ME!

I just paid 14k at a dealer for a white 99 legnum with 75kms on the clock. I have the same story and thought everything would be ok, i had paid for a warranty.
Now i just found out The waranty covers no more than $1800.
They have quoted me to replace the complete transmission for around $ 4000. I have owned the car less than 2 months. I have driven it around 4000kms.

It has totally screwed me. my only hope is someone on this forum having done a manual conversion to sell me a transmission at a mates rates cost.
I simply could not believe in 4000 kms i would be up for a new transmission. This car was listed at 190000 $!
Im devo hey. Any help in any form of advice, be it legal or helping me find a decent transmission at a decent price would be a gift from god.

Thanks for reading guys.

How long was the dealer statutory warranty for? Did u make a complaint to them before the end of it? IF u have evidence that they knew about the issues before the end of the dealer warranty then from what I know it is their responsibility for the repairs altho I could be wrong...

I was pretty lucky to find a replacement gearbox considering I was searching for over a month but it was pretty close to xmas then to. The one I found was very cheap but still needed a rebuild for soft parts.

Good luck.with it mate I hope u have alot better luck then me

Update: they are going to finish putting it all back together today and put the transmission bits cleaned in the boot for me to pick it up this arvo :) without paying a cent for them to strip and diagnose so little win there I guess... And almost got all the cash I need for the conversion so ill be ordering that in the coming days.... Now just to wait for fair trading to contact on wats gonna happen with my claim against them :) hopefully its positive

wahoo got my car back :) it is now safely at my mates place around the corner with 8 foot fences and a gaurd dog :p well it is Inala....

Was a bit of a pain in the ass since they locked my keys in the center console and I dont have a spare :( lucky the tow truck driver had some tools to assist and got it unlocked without damage :) didnt realise just how easy it is to break into a car :S

So they put he exhaust back on and the front part of he gearbox housing too, the rest of the parts including my transfer case and the rest of my gearbox were clean and in my boot with rags under everything and boxes for bolts and smaller parts... only thing not on or in the car was the driveshaft which they had on the ground beside the car...

Gonna start taking out the rest of the auto parts out getting ready for the manual conversion on the weekend :)
